Fees for Service of Process

Pursuant to Act Number 11 of the First Extraordinary Session of the 2000 Louisiana  Legislature effective July 1, 2000 all Sheriff docket fees in the various parishes of  the State of Louisiana are set at the following rates:

Service and returns of all legal documents, notices and subpoenas	$20.00 *
Execution of all writs and court orders	$30.00
Execution of all Notice of Seizure and returns thereon	$20.00
Preparing advertisement for newspapers, per one hundred words	$20.00
Execution of writ of possession or ejectment	$20.00
Service of Notices to Vacate and other eviction actions	$20.00

 *     Some parishes charge an additional mileage assessment which will be added to the above costs when the actual mileage is calculated.  The  Office of the Civil Sheriff does not assess such a charge, for Orleans Parish services.   The office does collect such charges for other parishes when Orleans Parish documents are served in other parishes and such mileage charges are subsequently billed by the sheriffs’ offices for those parishes.  These charges will be billed by follow up statements to litigants.

Deposits

• $1,500.00 * deposit towards costs and fees is required in all cases involving writs of sequestration..
• $1,200.00 * deposit towards costs and fees is required in all real estate  foreclosures.
• $500.00 *  deposit is required in all movable foreclosures and evictions.

 **            Additional deposits or security will be required where increased costs involved in eviction, storage, insurance, and other expenses are  anticipated .  The amounts involved will be determined on a case by case basis.

 Commissions

 Sheriffs’ commissions for sales of movables are set at 6% of the sale price.  Sheriffs commissions for sales of immovable property is set at 3% of the sale price.
